The Workplace Relations Commission dismissed Siobhan O’Connor’s disability discrimination complaint against Fitzpatick’s Supervalu after she did not attend the hearing. The WRC decision was dated 28 May 2024. O’Connor alleged that she was discriminated against because of a disability under the Employment Equality Act 1998. The respondent rejected the claim and attended the hearing with witnesses. The WRC was satisfied that O’Connor had been properly notified of the hearing arrangements using the contact details she had supplied and her consent to email communication. As O’Connor did not attend or give evidence in support of her claim, the merits were not decided. The adjudication officer declared the complaint not well founded, and the decision specifies no monetary award.
