The Workplace Relations Commission ruled that it did not have jurisdiction to hear Luca Avalle’s unfair dismissal complaint after finding that he had knowingly waived his right to bring the claim in a severance agreement. The WRC decision was dated 14 May 2024; the merits were not decided. Avalle said his role was made redundant and that the same job was advertised soon afterwards at a lower salary. Sysdig Limited argued that the agreement, entered into with informed consent in exchange for payments, barred the claim. The adjudicator noted that Avalle had received statutory redundancy, contractual notice and an ex-gratia payment as part of a severance sum exceeding €50,000.
