The Workplace Relations Commission (WRC) directed Carcharger Ev Ltd to pay Eric Bentley €295.08 for unpaid annual leave and €300 in compensation. Adjudication Officer Marie Flynn’s decision was dated 20 May 2024. Bentley said he had not been paid for annual leave accrued during his employment. The company accepted that it had missed the payment and said it had already paid him €843.07 for 3.2 days. The adjudicator calculated that he was entitled to 4.32 days, leaving a shortfall of 1.12 days. The WRC found the annual leave complaint well founded and ordered payment for the shortfall, plus compensation for the breach of his rights under the Organisation of Working Time Act 1997. It declared the separate notice pay complaint not well founded because Bentley had fewer than 13 weeks’ service and the WRC lacked jurisdiction to investigate it; the merits were not decided.
