The Workplace Relations Commission found Derek Byrne’s five complaints for redundancy pay, notice pay and unpaid wages not well founded, ruling that he had named the wrong employer. In a decision dated 5 June 2024, the adjudication officer found that Castle Rook Limited was Byrne’s employer, not Clonmannon Retirement Village Limited (In Liquidation). Byrne said he began work for Castle Rook in 2018 and was told his employment transferred to the respondent in 2022. The liquidator said there was no documentation supporting a transfer and that the respondent had no employees and had never traded.
