WRC complaint over employment terms change ruled out of time

By Cathal Brosnan

Workplace Relations Commission ·

The WRC ruled that Lee Smith’s complaint against Abbot Ireland Limmited, alleging he was not given written notice of a change to his employment terms after being assigned a project-management role, was out of time. The company denied breaching the law and argued the complaint was late. The adjudication officer found that even using the later date when the change was reversed, Smith’s October 2024 complaint fell outside the six-month limit. The officer had no jurisdiction to consider the complaint, and no compensation was awarded.
