The Workplace Relations Commission found Colm Harte’s complaint against South Dublin County Council not well founded. The decision was dated 28 August 2025. Harte challenged a voluntary redundancy scheme’s eligibility rule limiting access to staff below preserved pension age. The council said he was ineligible because he had reached that age. The adjudication officer found the rule formed part of a collective agreement and concluded that the Employment Equality Act permits different ages for admission to occupational benefit schemes, including redundancy schemes.
