The Workplace Relations Commission found Marco Pacheco’s complaints against Apleona Ireland Limited not well-founded and made no compensation award. Adjudication officer Michael MacNamee found insufficient evidence that Pacheco had a disability at the relevant time or that the company knew, or should have known, he had one. Pacheco alleged discriminatory dismissal and victimisation after raising workplace concerns and pursuing a grievance. Apleona disputed the claims and said it dismissed him during probation for performance reasons. Both complaints were rejected.
