The Labour Court upheld the Adjudication Officer’s decision on Eve Doherty’s appeal over her claim that she was penalised for making a protected disclosure. The decision is dated 23 November 2023. The appeal failed because Doherty confirmed she had not made a disclosure to a Garda member as required by the Criminal Justice Act 2011. Doherty said her employer, An Garda Siochana, penalised her by placing her on unpaid suspension while she served a prison sentence. The respondent disputed that she had made a qualifying disclosure or had been penalised for doing so. The Court found the complaint must fail because she had not made the disclosure required by the Act.
