Noel Flynn’s disability discrimination complaint against Emerald Facility Services failed at the Equality Tribunal. In a decision dated 5 August 2009, Equality Officer Conor Stokes found that Flynn had alcoholism, covered by the disability ground, but had not told the company about it or asked for reasonable accommodation. Flynn said the company took disciplinary action after alcohol-related incidents without addressing his difficulties. The company said it offered him work at another site, which he declined, and that he requested his P45. The officer found insufficient evidence that a dismissal took place, so Flynn had not established facts showing discriminatory treatment.
