Equality Officer finds Frank Flaherty discriminated against Vilius Skeiverys and orders €15,000

Workplace decision ·

An Equality Officer found that Frank Flaherty discriminated on grounds of race by dismissing truck driver Vilius Skeiverys and ordered €15,000 compensation. The decision was dated 13 October 2010.

Skeiverys said employees of other nationalities with less service were retained and that Flaherty had raised no performance concerns with him. Flaherty did not attend the hearing. The officer accepted Skeiverys’s account and found that he had established an inference of discrimination that Flaherty did not rebut.

Skeiverys’s complaint about discrimination in his employment conditions failed because he did not show that other employees were treated differently over a written contract, terms of employment or health and safety documentation. He withdrew the health and safety training and tax-documentation elements of his complaint at the hearing.
