The Equality Tribunal found that The Sunway Travel Group did not dismiss Marina Brady in a discriminatory manner on the grounds of gender or family status. The decision was dated 9 January 2012. Brady said she was selected for redundancy while on maternity leave without selection criteria or consideration of alternative roles. The company said financial difficulties led it to select staff for redundancy using a last-in, first-out process across its branches. The Equality Officer accepted that one employee from each of five branches, including Brady, was selected using that process, and found it was unrelated to pregnancy or marital status. Brady withdrew her access-to-employment and victimisatory-dismissal complaints at the hearing.
