Workplace decision ·

The Equality Tribunal found for Virgeo McEnery Landscapes Limited on Magnar Tonisson’s complaints about race discrimination in his working conditions, training and pay. Its decision was dated 9 January 2012. Tonisson withdrew his discriminatory dismissal complaint at the hearing. Tonisson said he was not given contract and safety documents in a language he understood, his hourly pay was reduced from €10.50 to €9.50 while an Irish colleague’s was not, and he was paid less than that colleague for like work. The company said it explained the documents, reduced other general operatives’ pay for economic reasons and paid the colleague more because he was a foreman. The Equality Officer found the company took reasonable steps to ensure Tonisson understood the documents. The pay reduction was attributed to economic factors, with no evidence linking it to nationality. The comparator was his foreman and supervisor, and the difference in pay reflected their different positions.
