Equality Officer Vivian Jackson dismissed James Gardiner’s gender discrimination complaint as frivolous after finding he had named the wrong respondent. The decision was dated 5 October 2012. Gardiner named Ashot Arutunyan as his employer, but the officer found that Four Star Royal Ltd. had employed him. A bank letter about Gardiner’s unpaid final-week cheque named Four Star Royal Ltd. as the drawer. After the officer invited Gardiner to comment on the issue, he did not respond by the deadline. The officer found the complaint had no prospect of success because the correct respondent could not be substituted and the time limit prevented a new complaint. The merits of the discrimination allegation were not decided.
