Equality Tribunal rules disability harassment complaint out of time

By Cathal Brosnan

Workplace decision ·

The Equality Tribunal found it lacked jurisdiction to investigate a worker’s disability harassment complaint because it was brought outside the time limit. Equality Officer Stephen Bonnlander dated the decision 22 October 2012. The merits were not decided. The worker said her employer sent her home after commenting on medication she took for depression. She confirmed at the hearing that the comment was made on 28 October 2009. The complaint was received on 29 April 2010, and no application to extend the time limit was made. The employer did not attend the hearing.
