Equality Tribunal rejects employee’s discrimination, harassment and victimisation complaints

By Donal Gilhooly

Workplace decision ·

The Equality Tribunal rejected an employee’s complaints of discriminatory treatment, harassment and victimisation on gender and disability grounds. Equality Officer Conor Stokes dated the decision 29 November 2012.

The employee said she faced discriminatory behaviour and harassment and was not given reasonable accommodation during her employment. The respondent denied the allegations and said she had been absent from work from 31 August 2007 before retiring on ill-health grounds on 16 November 2007.

The officer found no evidence of less favourable treatment or victimisation in the relevant period and was not satisfied that the employee had been forced to retire. The complaints failed.
