Equality Officer rejects two workers’ race discrimination complaints against Allied Mechanical Engineering Services

By Tadhg O'Sullivan

Workplace decision ·

An Equality Officer found that Sebastian Szmidt and Robert Siwczak were not discriminated against on grounds of race in their working conditions or dismissal by Allied Mechanical Engineering Services Ltd. The decision was dated 7 March 2013. The complainants, Polish nationals employed as general operatives, said they had not received employment contracts and were dismissed while Romanian co-workers were retained. The company was in liquidation and did not attend the hearing. The officer found it had not provided contracts to either Irish or non-national general operatives, and that the complainants had not established a connection between their dismissal and their race. A Polish co-worker had been retained at another site.
