Equality Tribunal finds safety training company did not discriminate against employee

By Cathal Brosnan

Workplace decision ·

The Equality Tribunal found that a safety training company did not discriminate against an employee with a disability, fail to provide reasonable accommodation, harass or victimise her. Equality Officer Conor Stokes dated the decision 26 April 2013. The employee said the company failed to address rodents at her workplace, did not provide the measures she sought, harassed her and dismissed her under the guise of redundancy after she raised statutory rights. The company said it took steps to address the rodent problem and made her role redundant because of financial losses and insufficient work. The Equality Officer found the company knew of the disability from the employee’s letter of 29 July 2010, but had provided reasonable measures in the circumstances. He did not find harassment or discriminatory dismissal, and found the company rebutted the inference of victimisation, relying particularly on financial accounts. All elements of the complaint failed.
