Equality Tribunal rejects rehabilitation assistant’s race harassment complaint

By Aoife Loughran

Workplace decision ·

The Equality Tribunal rejected rehabilitation assistant Ofome Ughwubrusi’s race harassment complaint against Acquired Brain Injury Ireland. The decision was dated 27 September 2013. Ughwubrusi said her manager called her a “bull” and bullied her. The Equality Officer accepted that the manager used the phrase “bull in a china shop” and found it caused a misunderstanding. The officer found no other evidence substantiating the bullying allegations. Ughwubrusi also alleged that colleagues made false accusations that she had left work. The organisation investigated two incidents, did not pursue the first because of contradictory evidence, and found that she had left the premises for 20 minutes during the second, resulting in a written warning. The officer found that the organisation followed its procedures and that Ughwubrusi had not established harassment on the race ground.
