Equality Officer rejects bus driver’s disability discrimination complaint

By Tadhg O'Sullivan

Workplace decision ·

The Equality Officer found that a transport company had not discriminated against Mr A on disability grounds when it retired him on ill-health grounds, and had met its duty to provide reasonable accommodation. The decision was dated 24 May 2016.

Mr A, a bus driver, said he could no longer drive after developing panic attacks and was later unable to manage a temporary engineering role. The company said it had supported him through sick leave, retraining, occupational-health reviews and an alternative role.

The Equality Officer found the company had engaged with Mr A over several years and was not legally required to adapt the alternative role. The company was entitled, after that process, to retire him when he could not resume his driving duties. The training and employment-conditions aspects failed because no evidence was presented on them. A separate complaint under the Equal Status Acts was withdrawn.
