Equality Officer dismisses McDonagh family’s discrimination complaints after they miss hearing

By Cathal Brosnan

Workplace decision ·

An Equality Officer dismissed Patrick and Ellen McDonagh’s Equal Status complaints against Clare County Council after they did not attend a callover on 15 January 2007. The decision was dated 22 March 2007, and the merits were not decided. The McDonaghs alleged discrimination on the Traveller community ground in housing services and harassment. Their representative said Patrick McDonagh had just come out of hospital, but the officer found no supporting evidence of this and no explanation for Ellen McDonagh’s absence. The officer was satisfied that the complainants had been notified of the callover and found they had not given a satisfactory reason for missing it. She dismissed the complaints after they failed to establish a prima facie case. The dismissed cases also included those of their children Edward, Julie-Anne, Patrick, Tommy, John, Simon, Helena and Martin McDonagh.
