Equality Officer rejects hotel discrimination complaint; second complaint fails after absence

By Niamh Kearney

Workplace decision ·

John Hahessy’s complaint that Grants Castle Hotel, Cashel discriminated against him on marital-status grounds was not well founded, an Equality Officer found in a decision dated 16 September 2008. A female complainant’s separate complaint failed after she did not attend the hearing; the merits were not decided.

Hahessy said the hotel manager asked him to leave because his wife worked there and the manager knew they were separated. The hotel said the manager was concerned about the effect on his wife and that an earlier nightclub ban did not influence her decision.

The Equality Officer accepted that personal concern for Hahessy’s wife, rather than his marital status, prompted the manager to ask him to leave. The two complaints were not well founded.
