An Equality Officer found that a pupil’s disability discrimination complaint against a primary school was not well founded. The decision was dated 30 July 2010. The complaint concerned alleged treatment during the 2006/2007 school year, including a failure to provide reasonable accommodation.
The pupil’s side alleged that a teacher treated him harshly and failed to make allowances for his disability. The school denied less favourable treatment and said it included him in activities and provided assistance.
The officer found the pupil was generally treated similarly to other children and received extra help when needed. The evidence did not show that this made it unduly difficult or impossible for him to access education. The officer also found the witness evidence inconsistent and not compelling. An alleged incident before the 2006/2007 school year was out of time.
