Equality Tribunal dismisses student’s discrimination complaints as out of time

By Gráinne Nolan

Workplace decision ·

The Equality Tribunal found that a student’s disability discrimination and victimisation complaints against an institute of technology were referred outside the time limit. The merits were not decided. Equality Officer James Kelly dated the decision 23 November 2011. The student said the institute discriminated against her in its handling of her studies, examination results and requests for information, and victimised her after a solicitor wrote on her behalf. The institute denied the allegations and said it had tried to support her. The officer found that the alleged conduct related to earlier dealings, which the student said she became aware of on 27 July 2007. Later information requests did not make the conduct ongoing. She referred the complaint on 6 February 2009 and had not applied for an extension of time.
