An Equality Officer rejected a complainant’s claims that a bus service discriminated against him because of disability and failed to provide reasonable accommodation. The decision was dated 29 June 2012. The complainant said drivers did not consistently lower the kneeler, stop at proper stops, wait for him to sit or provide requested assistance. He also raised the loss of restroom breaks. The bus service rejected discrimination, saying it provided assistance where possible and that drivers would make a bathroom stop on request. It accepted that one driver had parked improperly and did not know how to operate the kneeler; it said the driver was disciplined and the service apologised. Equality Officer Tara Coogan found that the complainant had been able to use the service despite difficulties and that the service had acted when problems were reported. She concluded that he had not established less favourable treatment because of disability or a failure to provide reasonable accommodation. The issue of erratic driving was outside the Tribunal’s jurisdiction.
