The Labour Court determined that the canteen operated by Gardner Merchant at Áras Attracta did not meet the Catering Joint Labour Committee’s definition of a catering establishment. It found the worker was outside the JLC’s scope. The decision was dated 11 November 1996. The Services Industrial Professional Technical Union argued that non-residents regularly used the canteen and that the worker should receive the JLC minimum rate. Gardner Merchant said the canteen was not open to the public.
