In 2002, the Labour Court found that a hospital discriminated against a kitchen porter by failing to provide working conditions free from discrimination, and awarded her €10,000. The determination was signed on 9 October 2002.
The worker had reported sexual harassment but had not named the alleged harasser. The Court found that during this period the hospital should have taken proactive steps, including contacting her union and transferring her to another work area. It accepted that the hospital had taken sufficient preventive steps before the reports.
After she named the alleged harasser, the hospital promptly suspended him and began an investigation. The Court found the later process was fair, but could not be completed because the worker and her representative did not cooperate with the investigation and disciplinary inquiry.
