In 1992, the Labour Court upheld an Equality Officer’s finding that an employer discriminated against a female employee who was sexually harassed by two male employees. It varied the compensation to 52 times her weekly remuneration. The determination was dated 13 August 1992.
The employer had appealed the finding and the Equality Officer’s recommendation of £7,000 compensation. The Court found the employer had not taken reasonable steps to prevent harassment because ordinary staff had not been informed of its guidelines. It considered 104 weeks’ remuneration warranted, then reduced that amount by 50% in light of the employer’s response after it learned of the incident.
