The Labour Court determined that Kardex Systems Ireland Limited should transfer sufficient money into the pension funds to meet its obligations to the two scheme members and comply with their pension-benefit terms. The determination was signed on 7 November 2007 and followed Amicus’s application over the company’s failure to implement an earlier recommendation. The earlier recommendation, issued on 21 May 2007, said the members’ pension entitlements should not be altered and the scheme should remain open for current commitments. Kardex did not attend the hearing but offered by email to contribute up to €100,000 to reduce the shortfall; Amicus considered that offer unacceptable. The Court said it had not agreed to vary the earlier recommendation and had not found it was based on unsound or incomplete information. It determined that the pension entitlements remain unchanged and that the scheme remains open for current commitments.
