The Labour Court overturned a Rights Commissioner’s decision in favour of Phil Grimson, finding the union complaint against Roches Stores not well founded. The determination was dated 21 May 2001. The dispute concerned a public holiday that fell on a Saturday, when Grimson did not normally work. He expected a day off in lieu on the following Monday; the company said staff could take a day off within a month. The union argued that the company had failed to consult employees or their representatives. The Court found the company’s practice consistent with the Organisation of Working Time Act 1997.
