The Labour Court reduced compensation for farm worker Anatoliy Kholod from €4,391 to €3,050 after his employer, Michael Gallagher, appealed. The determination was signed on 10 October 2005. Kholod had claimed unpaid annual leave and public-holiday entitlements, excessive weekly hours and missed daily and weekly rest periods. Gallagher disputed the claims. The Court said neither party’s evidence was wholly convincing and described Kholod’s account of his hours as exaggerated. The Court set compensation at €1,200 for annual leave and €350 for public holidays. It set a combined €1,500 for the weekly-hours and daily and weekly rest claims, without allocating that amount among them.
