The Labour Court added €1,750 to Denis Kostocenko’s award against Goode Concrete Limited, bringing his working-time compensation to €2,750. The determination was signed on 22 February 2008. Kostocenko said his mobile delivery work made it difficult to take breaks. The court preferred his evidence and found his work schedule left little or no practical opportunity to take adequate breaks. His holiday-pay complaint was not pursued at the hearing, and the court affirmed the finding that it was not well founded. The court left the €1,000 award for inadequate notice of overtime unchanged and varied the Rights Commissioner’s decision to add compensation for the breaks breach.
