The Labour Court raised compensation for Rolandas Venckutonis from €1,250 to €2,500 on his appeal against Dublin Building Services. The determination was signed on 27 July 2007.
Venckutonis said he worked more than 48 hours a week without adequate rest periods and that his employer kept no records. Dublin Building Services said he worked casually, two or three days a week when required, and received sufficient rest.
The Court noted that the employer could not provide records it was required to keep. It said compensation should be more than nominal and have a deterrent effect. The Court allowed the appeal, varied the Rights Commissioner’s award to €2,500 and directed the company to pay it.
