Labour Court varies decision, awards Gerli Parman €300 for records breach

Labour Court ·

The Labour Court varied the Rights Commissioner’s decision in Gerli Parman’s working-time appeal, awarding her €300 because her former employer, Pauline Maguire, trading as Toffee & Thyme, failed to keep prescribed records. The determination was signed on 24 November 2008. Parman’s appeal on rest periods and overtime was dismissed. The Court preferred the employer’s evidence on those issues. Parman said her rota changed, she sometimes had no breaks and she was not paid overtime premiums. The employer said staff received scheduled breaks and she did not work more than 39 hours a week. Parman accepted that she had not worked more than 48 hours a week, and neither side pursued the 11-hour rest-period issue.
