The Labour Court reduced compensation awarded to Eugenijuis Leita from €3,000 to €500 after Patrick Callaghan, trading as Callbruno, appealed. The determination was signed on 2 February 2009. Leita complained that he had not received adequate rest breaks and had worked more than the permitted hours for night workers. Callbruno said it tried to ensure he took adequate breaks, but he returned to work early or took breaks late. The Court found admitted breaches of the rest-break rules, which it considered minor, and said prescribed-form records did not appear to have been kept. It did not necessarily accept that the night-work limit had been breached, noting that the company relied on four interpretations from the department responsible for the legislation.
