The Labour Court reduced Dangoule Kluonyte’s compensation from €6,500 to €3,750 after Europa Plus Limited appealed a finding that it failed to provide required rest breaks. The determination was dated 5 November 2009. Kluonyte worked as a cleaner for the company from May 2007 to August 2008. Europa Plus said she had opportunities to take breaks, but could not show if or when she received them and acknowledged that it had not kept the required records. The Court left the finding of liability in place, but considered the original award disproportionate because Kluonyte had suffered no financial loss.
