Labour Court overturns decision and awards Agnieszka Anastazjew €1,500

Labour Court ·

The Labour Court overturned a Rights Commissioner’s decision and awarded Agnieszka Anastazjew total compensation of €1,500 after finding breaches of working-time and record-keeping rules. Its determination was signed on 19 March 2009. Anastazjew said she had not received Sunday premium or public-holiday entitlements and had been underpaid for annual leave. Her employer, Svetlana Kuzinsky trading as Assorti, said weekly cash payments were intended to cover annual leave and public holidays. The Court found shortfalls of €175 for Sunday premium and €725 for annual leave and public holidays, along with breaches of the relevant rules and record-keeping requirements. It added €600 in compensation and overturned the earlier decision, which had found the claim not well founded.
