Labour Court leaves €1,000 award in place after Juris Kruglijs appeal

Labour Court ·

The Labour Court dismissed Juris Kruglijs’s appeal to increase a €1,000 compensation award for working-time breaches, leaving the award in place. The determination was signed on 13 May 2009.

Kruglijs had appealed a Rights Commissioner’s award, saying it did not adequately reflect excessive hours, incorrect holiday pay and inadequate rest breaks. At the hearing, former employer Michael Conlon did not attend but sent the Court an email.

The Court accepted that Kruglijs’s holiday pay had been about €5 an hour below the applicable construction agreement rate and accepted €750 as the estimate of arrears. It also noted the earlier findings that he worked excessive hours and did not receive adequate breaks. However, the Court said Kruglijs had asked for extended overtime and accepted the related payments, and saw no equitable basis to increase the award. The €750 holiday-pay arrears were separate from the €1,000 compensation award.
