The Labour Court allowed Wioletta Morkis and Katarzyna Uciechowska’s appeals and set aside the Rights Commissioner’s decision that their working-time complaints were not well founded. It awarded Morkis €2,300 and Uciechowska €2,150, including €1,600 each for economic loss. The determination was signed on 22 February 2010.
The shop assistants said they worked full-time, often on Sundays and public holidays, without the required benefits. Rezmerita Limited said they worked part-time and received Sunday premiums, paid annual leave and paid days off for public holidays. The company accepted it had not kept the required working-time records.
The Court found the company had not proved compliance with rules on breaks, Sunday work, annual leave and public holidays. It extended the time limit to cover complaints from the dates the claimants began employment, taking account of the company’s failure to provide payslips and employment particulars.
