The Labour Court set aside a Rights Commissioner’s decision against Aleksandrs Kulajevs after finding he had not breached the Organisation of Working Time Act. The determination was dated 16 July 2010. Noel O’Brien had argued that annual leave and public holiday pay were calculated below the Construction Industry Registered Employment Agreement rate. The Court said the appeal under the Act could not determine or enforce an Employment Regulation Order.
