Labour Court raises worker’s breaks award to €600 on appeal

By Aoife Loughran

Labour Court ·

The Labour Court increased an award to Irena Stankeviciene from €270 to €600 after allowing her appeal over breaks at work. The determination was signed on 3 August 2012.

Stankeviciene said she had not been given enough time for breaks. Office & Industrial Cleaners Ltd argued that travel between work locations gave her time to take them and that she had not raised concerns while employed.

The Court said the breaches were minor and noted that her contract provided for breaks and no clear obstacle prevented her from taking them. However, the employer had no system to ensure breaks were taken and did not actively manage compliance with the law.
