The Labour Court varied a €4,000 award to Darius Norkunas, awarding him €4,000 for four breaches of working-time law. In a determination dated 8 August 2012, it upheld the findings against M. McGuire Haulage Ltd on the company’s appeal, but changed the compensation to €1,500 for missed breaks, €1,500 for excess hours, €500 for inadequate notice of working hours and €500 for unpaid annual leave. Norkunas said he worked at least 12 hours a day, ate lunch while driving and did not receive correct public or annual leave entitlements. The company relied on vehicle tracking and weekly log sheets to argue it had complied. The Court found tracking recorded the truck’s activity, not Norkunas’s, and the logs did not show the breaks he actually took. Its weekly reports also showed hours above the 48-hour limit. The company provided no evidence to support its claim of an overpayment or to justify deducting it from his holiday pay.
