Labour Court rejects Ejaz Ahmed’s appeal over time-barred working-time complaint

By Ruairí Dolan

Labour Court ·

The Labour Court upheld a Rights Commissioner’s decision that Ejaz Ahmed’s working-time complaint against Indus Food Cash and Carry and Ms Amita Malkan, trading as Indus Foods Cash & Carry, was outside the time limit. The appeal failed, and the merits were not decided. The determination was signed on 5 September 2012. Ahmed complained that he had not received adequate rest periods, Sunday premiums, annual leave or public holiday entitlements. The Court refused to extend the deadline, finding that he had been advised of the time limits and chose not to pursue the complaint while his cousin worked for the employer. It said the delay after his cousin left was not explained.
