The Labour Court rejected Western Star Freight Limited’s appeal and increased compensation for driver Rimas Tamauskas from €3,000 to €5,000. The determination was signed on 26 September 2012.
Tamauskas complained that he lacked adequate daily rest, worked more than 48 hours a week and received too little notice of additional hours. The company conceded breaches of the daily-rest and notice rules, while disputing the excessive-hours allegation. The Court found the tachograph records could not establish compliance and that Tamauskas had been required to work excessive hours. It said compliance with the Act was a health and safety imperative and that compensation should deter future breaches. The company was also directed to ensure its records complied with the regulations.
