The Labour Court overturned the dismissal of Ioan Titieni’s working-time claims and awarded him €5,000. The Court dated its determination 24 February 2012, finding that former employer Des Lumsden had denied him weekly rest and annual-leave entitlements. Of the award, €2,000 covered holiday and cessor-pay arrears, with the remaining €3,000 awarded as general compensation. Titieni had worked as a construction operative. The Rights Commissioner had dismissed his claims for want of prosecution after Titieni failed to attend that hearing. Titieni attended the Labour Court appeal, while Des Lumsden did not. The Court heard Titieni’s evidence and found both complaints well founded.
