The Labour Court found Winston M Luza’s complaint against Top Security Ltd was not well founded and disallowed his appeal over public holiday entitlements. It varied the Rights Commissioner’s decision, which had found the complaint out of time. The determination was signed on 2 December 2013. Luza claimed outstanding public holiday entitlements for work before November 2012. Top Security Ltd argued that responsibility had transferred to Noonan Security Limited when Luza’s employment transferred. Luza accepted the transfer and said he had received public holiday entitlements since November 2012. The Labour Court found liability for the earlier claim had transferred with the employment.
