The Labour Court varied a Rights Commissioner’s decision and affirmed its €4,000 compensation award to truck driver Viktors Gurkovs on his appeal against O’Leary International Ltd. The determination was signed on 3 March 2014.
Gurkovs’ working-time claims covered breaks and rest periods, Sunday work, weekly hours, notice of work hours and public-holiday entitlements. The Court found the employer had not kept the required signed weekly time sheets, and that tachograph records did not establish compliance. It was not satisfied that the weekly-hours provision had been breached, and any holiday underpayment was already accounted for in Gurkovs’ separate minimum-wage claim. The other aspects of his claims were well founded. The Court affirmed the €4,000 award and varied the decision in the terms of its determination.
