Labour Court varies €20,000 award to security guard

The Labour Court varied a €20,000 award to security guard Damien Sheahan after his employer, Sword Risk Services Ltd, appealed. It ordered Sword Risk Services Ltd to pay him €4,750 for each of two working-time complaints and €300 compensation for annual-leave breaches. The decision was dated 7 April 2014.

Sheahan said he worked 12-hour shifts five days a week, mostly at an Aldi store on Parnell Street, Dublin. He complained that he did not get statutory breaks, worked more than an average of 48 hours a week, and was owed annual leave and cesser pay. Sword Risk Services Ltd disputed the complaints and said it had complied with the law.

The Court found the company knew Sheahan was not getting statutory breaks and did nothing to ensure he received them. It also found his average working week exceeded 48 hours and the company knew the hours he worked. On annual leave, it found he had accrued three days for which he had not received cesser pay. The order directed payment for eight days due to him, as well as €300 compensation for the breaches.
