Labour Court awards €2,000 to Igor Gordins in working-time appeal

Labour Court ·

The Labour Court found four working-time complaints by chef Igor Gordins against Hyper Trust Limited, trading as The Leopardstown Inn, well-founded, awarding him €100, €500, €2,000 and €900. In its determination dated 11 July 2014, it found the employer denied Gordins 20 minutes of daily rest on one occasion, failed to prove it provided statutory breaks, did not compensate him for Sunday work as required, and failed to give 24 hours’ notice for Monday shifts or set a finish time. The employer disputed the complaints. The Court said smoke breaks and free meals did not establish compliance with the break rules, while free meals could not replace the money or paid time off required for Sunday work. It also found that the employer could have scheduled Gordins to start 20 minutes later on the isolated rest-period breach and could use the restaurant’s closing time to set his finishing time.
