Labour Court upholds time-limit decision on Norah Flaherty’s complaint

By Saoirse Doyle

Labour Court ·

The Labour Court affirmed the Rights Commissioner’s decision that Norah Flaherty’s working-time complaint against Covidien Tyco Limited was outside the time limit; the merits were not decided. The determination was signed on 21 October 2014. Flaherty told the Court that she was dismissed on 8 March 2013 and referred her complaint on 19 November, more than six months later. She said the employer had not contravened the Act during the six months before she complained. She explained that she delayed while saving to hire a solicitor. The Court found this was not reasonable cause for extending the time limit.
