The Labour Court increased Edgarus Paulauskas’s compensation on his appeal against Petrogas Group Ltd, upholding his rest-between-shifts and Sunday-work complaints and finding a breach over the special break required for shop workers. It also ordered a Sunday premium of time plus one third. The decision was dated 29 August 2016. The Court awarded €150 for missed rest between shifts, €250 for failing to provide the one-hour shop-worker break and €850 for Sunday work. It found Petrogas had not kept the required hours records and that Paulauskas’s evidence matched the rosters. It also found no evidence that his €22,000 annual salary compensated for Sunday work. The Court upheld his complaints about late notice of the business transfer and late written employment terms, ordering one week’s wages for each. It found he had received written notice of the transfer, but not in good time. His complaints about ordinary break scheduling, notice of working hours and holiday-pay calculations were not well founded.
